Terms of Service

1. Agreement

By accessing or using https://crm.biggaponbd.com (the "Service"), operated by Biggapon BD ("we", "us"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Service Description

Biggapon BD is a Meta Ads reseller platform that enables Bangladeshi businesses to:

  • Recharge Meta ad accounts in BDT via bKash, Nagad, Rocket, or bank transfer.
  • Share ad accounts with partner Business Managers.
  • Automate ad account top-ups and budget management.
  • View consolidated ad account performance and transaction history.

3. Account Registration

  • You must be at least 18 years old and legally able to enter contracts.
  • You must provide accurate, complete, and current information.
  • You are responsible for safeguarding your password and all activity under your account.
  • Notify us immediately at support@biggaponbd.com of any unauthorized access.

4. Payment Terms

  • All deposits are in Bangladeshi Taka (BDT).
  • Service fees, FX rates, and minimum deposit amounts are displayed in the dashboard before confirmation.
  • Deposits are reviewed and credited to your wallet typically within a few hours during business hours.
  • Wallet balances are non-transferable to other users.

5. Refunds

Wallet deposits are refundable in the following cases: (a) duplicate payment, (b) payment not credited despite successful debit, or (c) account closure with unused balance. Refunds are processed within 7–14 business days to the original payment method, minus applicable processing fees. Funds already spent on Meta ads are non-refundable.

6. Acceptable Use

You agree NOT to:

  • Run ads that violate Meta's Advertising Policies or Bangladeshi law.
  • Use the Service for fraud, money laundering, or any illegal activity.
  • Attempt to bypass security controls, scrape, or reverse-engineer the platform.
  • Resell, sublicense, or share your account credentials with third parties.
  • Upload malware or interfere with the Service's operation.

Violation may result in immediate account suspension and forfeiture of unspent wallet balance.

7. Meta Platform Compliance

You acknowledge that ad accounts and campaigns are subject to Meta Advertising Policies. Biggapon BD is not responsible for ad rejections, account disables, or restrictions imposed by Meta. We act solely as an intermediary and cannot override Meta decisions.

8. Service Availability

We strive for 99% uptime but do not guarantee uninterrupted service. We may temporarily suspend the Service for maintenance, updates, or events beyond our control (force majeure, Meta API outages, payment gateway failures).

9. Intellectual Property

All content, branding, code, and design of the Service are the exclusive property of Biggapon BD or its licensors. You receive a limited, non-exclusive, non-transferable license to use the Service. No other rights are granted.

10. Disclaimers

The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied. We disclaim all warranties of merchantability, fitness for a particular purpose, and non-infringement.

11. Limitation of Liability

To the maximum extent permitted by law, Biggapon BD shall not be liable for indirect, incidental, consequential, or punitive damages, including loss of profits, data, or ad performance. Our total liability for any claim shall not exceed the total fees you paid us in the 3 months preceding the claim.

12. Indemnification

You agree to indemnify and hold Biggapon BD harmless from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights (including Meta's policies).

13. Termination

We may suspend or terminate your account at any time for breach of these Terms, fraud, or legal violation. Upon termination, your access to the Service ends immediately. Refundable wallet balance (if any) will be returned per Section 5.

14. Governing Law

These Terms are governed by the laws of the People's Republic of Bangladesh. Any disputes shall be resolved in the courts of Dhaka, Bangladesh.

15. Changes to Terms

We may modify these Terms at any time. Material changes will be notified via email or in-app notice at least 7 days before taking effect. Continued use after changes constitutes acceptance.
